The AACE International’s Source Magazine has published Mark Nagata’s article, entitled “Home Office Overhead – Which Formula Should You Use?” in its August 2020 issue, in the “Bonus Technical Article” section. This article describes the difference between unabsorbed and extended home office overhead costs, details how various home office overhead formulas calculate a contractor’s unabsorbed or extended home office overhead costs, and identifies how each of the methods calculate different potential damages from one another using an owner-directed suspension example and an extended project duration example.

On August 7, 2020, Bill Haydt will present a 90-minute Edupliance Webinar “A Guide to Determining the Costs Associated with Delay.” Bill will discuss how vital it is to know the process for submitting or reviewing delay claims, as well as how to approach modifying the contract. He will review the methods of documenting impacts, as well as how to categorize and present costs. On May 5, 2020, Scott Lowe and Mark Nagata will present a Webinar for the Upper Great Plains Transportation Institute “Determining a Contractor’s Entitlement to a Time Extension Due to COVID-19.” Scott and Mark will review the Wyoming, Montana, and North and South Dakota DOT contracts. They will discuss what these contracts require regarding a contractor’s obligations to establish entitlement to a time extension for alleged COVID-19 delays. They will look at whether COVID-19 delays are excusable under a contract, and discuss why they may not be compensable. They will discuss how to analyze a project’s schedules to quantify a delay associated with COVID-19, as well as identify the required documents a contractor must submit to verify and quantify COVID-19 delays.

Geoff Page will be presenting a 2-day NHI Course in Denver, CO, titled “Principles and Applications of Highway Construction Specifications,” on March 10 and March 11, 2020. The course includes content that highlights the role of specifications as contract documents and tools for assigning risk. Course participants will engage in lessons and practice sessions to identify types of specifications, select the most appropriate type for a given project, and generate an original, effective highway construction specification. Emphasis is placed on the use of basic grammar and writing style so that participants can produce correct, consistent, clear, complete, and concise specifications.
