The Lott Group entered into an agreement with the State of New Jersey, Department of the Treasury, Division of Building and Construction to design and construct a 192-bed, modular dormitory and support buildings at the Edna Mahan Women's Correctional Facility in Clinton, New Jersey. Lott entered into a subcontract agreement with Garrison Architects to design the site work, all building foundations, and the support buildings. In particular, Garrison was required to provide complete construction documents and specifications for the support buildings stamped and sealed by the architect and engineer, and all permits required for construction. Reliance Insurance Company, Lott's surety, took over completion of the project and contracted with Keating Company to perform the construction management and construction work necessary to complete the project. Trauner investigated items of additional work necessitated by alleged architectural errors, oversights, and omissions on the part of Garrison, and participated in the defense of claims made by subcontractors.
Trauner assisted Reliance in the preparation of a claim against the State and the architect, Garrison. Services included contract review, delay analysis, liability for delays, liability for issues in dispute, and damage calculations. Of particular note, we analyzed the State's actions during the review and approval of drawings to determine if the State acted in accordance with the contract. We assisted Reliance in drafting interrogatory responses.
