The project was a multiple-contract renovation and reconstruction of the 370-million-gallon daily intake, 144-acre Hyperion Wastewater Treatment Facility in Playa Del Rey, California. The contracts added capacity, preliminary treatment, and secondary treatment capability. Three of the prime contractors have filed claims for $66 million, $54 million, and $24 million. Claim issues include deficient design, design changes after bid, piecemeal construction, differing site conditions, and inconsistent inspection criteria.
Trauner was chosen as a member of the claims review team to review, critique, and evaluate the contractor's claims, and perform independent analyses as needed. Each contractor used a different method to identify delays and additional costs. Issues include extended submittal reviews, improper submittal rejection, differing site conditions, pile driving difficulties, excessive changes caused by deficient design, and losses of efficiency. In addition to helping evaluate the claims, Trauner has provided assistance in depositions and will be providing expert testimony at trial.
